Terms of Use (EULA) — Sailboat Docking Simulator

End-user licence agreement for the Sailboat Docking Simulator app (the “App”). By installing or using the App you accept these Terms. If you do not agree, do not use the App.

The App is published by individual entrepreneur [to be completed] (the “Developer”, “we”, “us”); details are at the end of this document.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use, in accordance with these Terms and the usage rules of the store from which you obtained it. You may not copy, modify, distribute, sell, rent or lend the App, or reverse-engineer or decompile it, except to the extent the law expressly allows.

2. Free content and Full access

Part of the App is free of charge: all ten lessons with quizzes, the controls tutorial and three introductory practice sessions (turning on the spot, backing out of a slot and berthing alongside).

Full access unlocks the remaining practice sessions, including both mooring labs, and weather variants in every practice session. Full access is sold as:

a monthly auto-renewing subscription (period: 1 month);
a yearly auto-renewing subscription (period: 1 year);
a lifetime one-time purchase.

The price of each option is shown in the App before you confirm the purchase, in the currency of your store account, and may differ by country. We may change prices for future purchases. A price change for an active subscription only takes effect from the next renewal, and the store notifies you in advance where the law or store rules require it.

3. Subscriptions and automatic renewal

Payment is charged to your Apple ID, Google Play or RuStore account when you confirm the purchase.
The subscription renews automatically at the end of each period for the same length and price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account is charged for the renewal within 24 hours before the current period ends.
You can manage or cancel the subscription at any time in your store account:
- iPhone / iPad: Settings → your name → Subscriptions;
- Google Play: Play Store → profile icon → Payments & subscriptions → Subscriptions;
- RuStore: RuStore app → Profile → Subscriptions.
Deleting the App does not cancel a subscription.
If you cancel, you keep Full access until the end of the period you have already paid for; no further charges are made.
The App shows the plan it last confirmed with the store. If the store cannot be reached, a subscription stays active for a short grace period after its end date, after which locked content is locked again until the store confirms a renewal.

4. Lifetime purchase and restoring purchases

The lifetime purchase is a one-time payment for Full access for as long as the App is distributed and supported on your platform. Purchases are tied to your store account. After reinstalling the App or moving to a new device signed in with the same account, use Settings → Full access → Restore purchases to recover them free of charge. Purchases cannot be transferred between Apple, Google and RuStore accounts.

5. Refunds

Purchases are made through the store, and refunds are requested from the store under its policy: Apple, Google Play, RuStore — through RuStore support in the app or on rustore.ru. Nothing in these Terms limits any statutory rights you have as a consumer, including a right of withdrawal or a right to a refund for digital content that is defective. The App is a training and educational tool. It simulates a sailing yacht under engine with a simplified model. It is not a substitute for practical instruction, supervised experience or the judgement of a qualified skipper, and must not be used for navigation or for decisions aboard a real vessel. Real boats, harbours, weather and equipment differ from the simulation. You alone are responsible for the safe handling of any vessel.

7. Updates and availability

We may release updates that change, add or remove features or content, and we may stop distributing the App or supporting a platform or operating-system version. We will try to keep Full access meaningful for as long as the App is distributed, but we do not guarantee that any particular exercise, lesson or feature will be available indefinitely.

8. Intellectual property

The App, including its code, texts, lessons, illustrations and sounds, is protected by copyright and belongs to the Developer or its licensors. These Terms give you no rights other than the licence in section 1. The App uses the PT Sans typeface under the SIL Open Font License 1.1.

9. Disclaimer of warranties

To the fullest extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that the App will be error-free or uninterrupted.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising out of the use of or inability to use the App — including any damage to a vessel, property or person resulting from reliance on the simulation. Our total liability for any claim relating to the App is limited to the amount you paid for the App in the twelve months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law, including your statutory consumer rights.

11. Termination

You may stop using the App and uninstall it at any time. We may terminate your licence if you breach these Terms. Sections 5–10 and 13–15 survive termination.

12. Store-specific terms

Apple. If you obtained the App from the Apple App Store, these Terms are between you and the Developer, not Apple. Apple has no obligation to provide maintenance or support for the App. Apple is not responsible for any product warranty, for addressing any claims relating to the App (including product liability, legal or regulatory compliance and consumer protection claims) or for third-party intellectual-property claims. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation. You confirm that you are not located in a country subject to a US Government embargo or designated as “terrorist supporting”, and are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. The Apple Licensed Application End User License Agreement also applies; where it conflicts with these Terms, it prevails.

Google Play. If you obtained the App from Google Play, the Google Play Terms of Service also apply to your purchase.

RuStore. If you obtained the App from RuStore, the RuStore user terms also apply to the download and payment. For users in the Russian Federation the Russian-language version of these Terms, which is a public offer of a licence agreement, is the governing text: Условия использования.

13. Changes to these Terms

We may update these Terms. The current version is always published at this address with its effective date. If you continue to use the App after a change, you accept the updated Terms; if you do not agree, stop using the App and cancel any subscription.

14. Governing law

These Terms are governed by the laws of the Russian Federation, without prejudice to the mandatory consumer-protection rules of the country where you habitually reside, which continue to apply to you.
